Sale Champions Auction Terms & Conditions


1. Acceptance of Terms

By consigning a horse (“Equine”) with Sale Champions (“Auctioneer”), the Consignor (“You”) agrees to abide by these Terms & Conditions. Submission of the Equine to the auction constitutes acceptance of these terms.


2. Consignor Eligibility

  • You warrant that you are the legal owner of the Equine or have express authority to act as the owner’s agent.
  • Agents must disclose their status and provide written proof of authorization.

3. Listing Requirements

You agree to provide:

  • Accurate Information: Registered name, age, color, pedigree, and registration number.
  • Disclosures: Check all applicable boxes for known vices, injuries, or chronic conditions.
  • Media: Four (4) high-quality photos and one (1) video showcasing movement (walk/trot/canter).
  • Health Records: Current negative Coggins test (within 12 months), vaccination history, and farrier records.

4. Auction Process

  • Reserve/No Reserve: Specify if the Equine has a reserve price. If unsold, it may be relisted once at no cost.
  • Bidding: Auctioneer (Tommy Williams) reserves the right to reject bids, settle disputes, or withdraw listings for misrepresentation.
  • “As-Is” Sale: All sales are final. No warranties (express or implied) are provided by Auctioneer.

5. Commission & Fees

  • Seller Commission: 10% of the final sale price, deducted post-sale.
  • Agent Commission: If consigning as an agent, you split the 10% commission 50/50 with Sale Champions.
  • No Upfront Fees: No listing, advertising, or administrative charges.
  • Non-Payment by Buyer: If the buyer defaults, the Equine will be relisted, and original Consignor owes no fees.

6. Payment to Consignor

  • Timing: Payment issued via [Insert Method] within 7 business days after buyer’s payment clears.
  • Taxes: Consignor is responsible for reporting income.

7. Consignor Warranties

You represent and warrant that:

  • The Equine is free of liens, encumbrances, or legal disputes.
  • All disclosed information (health, pedigree, soundness) is truthful.
  • The Equine has no known current violations of the Horse Protection Act (HPA).

8. Indemnification

Consignor agrees to indemnify and hold harmless Sale Champions, its agents, and Tommy Williams from:

  • Claims arising from the Equine’s condition, title, or misrepresentation.
  • Violations of HPA or other equine regulations.

9. Media & Marketing Rights

  • Sale Champions may use submitted photos/videos for promotional purposes across social media, websites, and ads.
  • Consignor grants a non-exclusive, royalty-free license to Auctioneer for marketing. After entry is consigned, Sale of Champions owns copyright of all videos and photos and will be watermarked.

10. Liability Limitations

  • Auctioneer is not liable for Equine injury, illness, or death post-listing.
  • Maximum liability for Auctioneer is limited to the commission paid.

11. Dispute Resolution

  • Disputes governed by Tennessee law.
  • Mediation/arbitration required before litigation. Venue: Bedford County, Tennessee.

12. Prohibited Conduct

  • Fraudulent listings, undisclosed vices, or false pedigrees result in permanent bans.
  • Auctioneer may blacklist Consignors for unethical practices.

13. Termination

Auctioneer may remove any Equine from the auction for:

  • Failure to meet health/registration requirements.
  • Threats to the auction’s integrity.

14. Amendments

Sale Champions reserves the right to update these terms. Consignors will be notified via email or portal.
